In American society today, almost everyone, even six-year-olds, owns a cell phone with a camera. While convenient, camera phones also open the door to huge child pornography problems that arise from sexting or sending nude or lewd photos. According to a 2010 Federal Bureau of Investigation survey1 of 4,400 middle and high school students, “about 8 percent of students reported sending one-sixth of themselves to others, while thirteen percent said they received one sixth." The main problem with sexting, in addition to being considered child pornography if it is a photo of a minor, is the ease of spreading the sext to other contacts or even on the Internet. In the United States alone, several students have committed suicide after a sext intended for one person's eyes went viral or was sent to the entire high school. This was the case with Ohio high school student Jesse Logan, who sent nude photos to her boyfriend who then sent them to other students who harassed her into suicide.2 Currently, there are laws in place against child sexting and sexting to minors and fall into the category of child pornography. Although the laws are intended to protect minors from sexual predators, what most minors don't realize is that they too are subject to them. This means that if 15-year-old Timmy decided to sext his 15-year-old girlfriend, Sarah, a nude photo of herself, both Timmy and Sarah could be tried in court on charges of disseminating child pornography and possessing child pornography. These serious charges can result in the need to register as a sex offender for several years, even though the message may have been sent and received consensually by both parties.
