Today, there are so many legal dilemmas dominating trials that allow courts to make a solid legal decision about which right in a complicated situation. Despite the outcome of the case, the disagreement usually has a profound effect on the healthcare organization and the industry as a whole. Many cases are arguments centered on whether the issue is a legal or moral principle. Regardless of the situation, the final decision is left to the courts to distinguish between the issues of legality in question as opposed to justifying a case based on moral rules. According to Pozgar (2012), an ethical dilemma arises in situations where one must choose between unpleasant alternatives. It can occur whenever a choice involves giving up something good and suffering something bad, regardless of the course of action taken (p. 367).
