Topic > The Second Amendment to the United States Constitution...
Gun bans in Chicago and Oak Park Illinois prompted multiple lawsuits claiming it would take away their Second Amendment rights. It was concluded that the Fourteenth Amendment vests the right to keep and bear arms to individual states (“Oyez”). Many states and cities have gun laws, but these normally involve the open carry or process of legally purchasing a gun. These previously established laws are perfectly legal, but the laws involved in McDonald v. Chicago were not constitutional. Telling someone they can't openly carry a gun in public and telling someone they can't have a gun in their private home are two completely different issues on opposite sides of the situation.
