The federal judicial system, unlike Florida's judicial system, is made up of three levels. At the top of the list is the United States Supreme Court. The United States Supreme Court is also known as the court of last resort because it is the final stop in the judicial process. Article III, Section 1 of the United States Constitution creates the Supreme Court of the United States and gives Congress the authority to create the lower federal courts. Congress has the right to decide how many justices serve on the U.S. Supreme Court, but it cannot change the powers granted to it by the U.S. Constitution. The United States Supreme Court is the only court created specifically by the U.S. Constitution and is the most powerful level of the judicial system. The Judicial Act of 1789 established the court with a chief and five associate justices, but since 1869 there have been eight associates and one chief. To decide a case there must be at least six votes from the judges and all that is needed is a majority of votes. The United States Supreme Court is asked to hear thousands of cases per year, yet it only hears between 100 and 150 per year. The U.S. Supreme Court will only hear a case when there is a constitutional question at hand. One of the most notable cases was Marbury v. Madison in that it established judicial review. After reviewing this case, Chief Justice Marshall declared that "An act of legislation contrary to the Constitution is not law" and "It is decidedly the jurisdiction and duty of the judicial department to say what is law." Judicial review is also used on state and local governments. The court examines their actions and determines whether they are unconstitutional or not, and if so, orders them to stop the action in question.
