The problematic question does not indicate whether Roger is a citizen of an EU country or whether he is a British citizen. Therefore the answer to my problematic question will only assume that he is a British citizen. Although my guess will consider him to be a British citizen, in any case the law and rules that apply in the EU are the same for all EU member states. The problem concerns the status and rights accorded to the migrant citizen of the European Union in the host state. It concerns the status of worker and family under European Union law together with the application of the principle of discrimination and the right to equal treatment. Union citizenship was finally formally introduced into the European Union (EU) by the Maastricht Treaty in 1992 in an effort to bring the Union closer to its citizens. Throughout the problematic issue it will be assessed to what extent the introduction of citizenship into the EU legal framework actually adds concrete rights to EU citizens or whether it only has a symbolic importance. Article 20 states that every individual who is a citizen of a Member State is automatically also a citizen of the EU. Article 21 guarantees the right of free movement to all EU citizens within the limits of the Treaty and secondary legislation. The free movement rights of economically active citizens are well established in Article 45 of the Treaty on the Functioning of the European Union (TFEU).
