Consent: A Common Exception to the Fourth Amendment It is astonishing that in this day and age there is even a concern about the constitutional rights of suspects involved in computer crimes. The rights of the citizens of this country have been eroded by the passage of many laws including the USAPATROT Act. People can expect to have less privacy because of these laws. The government can enter the home of a person who is not suspected of terrorism or any criminal activity. They are free to search that person's house. There is a good chance that whatever crime is observed will not be ignored. If the government searches a home under a secret warrant under the law and finds child pornography, the suspect will certainly be prosecuted. It is nearly impossible to determine what type of defense an attorney would use. Perhaps the federal government would use evidence found regarding the law to alert local law enforcement to any violations of the law.
